What Are the Legal Details of Workers Compensation?

There are various ways to go about doing this and each state you live in will have their own unique methods. The doctors who work in a medical practice that participates in the comp plan must adhere to the rules and guidelines or they can be reprimanded by their medical board. You must go through the proper channels when it comes to workers' compensation lawyers and you must make sure that the doctors you see adhere to the rules and guidelines.

Your compensation plan can be broken up into many different parts, if you so desire. Each doctor who works in a medical office will have several areas of responsibility within their practice such as billing, office scheduling, appointment scheduling, and even secretarial duties. These are all separate from the doctors job titles and these different areas must be overseen by a specific team of Workers' Compensation Doctors. This team must consist of a Medical Reimbursement Specialist, a Medical Coding Specialist, and a Medical Assisting specialist.

The Medical Reimbursement Specialist is responsible for the patients' compensation. They will work directly with a physician to find the best treatment possible for the injury the patient has sustained. If a doctor does not treat the injury correctly it can lead to other complications. For example, if a doctor wrongly tests a patient for an underlying condition it can lead to that condition being misdiagnosed causing more complications. This can cause loss of life and suffering for both the patient and his/her family.

Once you have chosen your Workers Comp lawyer you must then choose from one of three types of lawyers. Depending on the type of work injury you suffered, you will decide which lawyer you will be assigned to. The three types of Workers Compensation attorneys are Certified Workers' Compensation Practitioner's; Home Based Business Counseling Agencies and Medical Malpractice Specialists. You can select any one of these groups, but they must agree to the terms before you can start the proceedings. The approved doctor for your case must also participate in the approved doctors panel.

You will receive a medical treatment for your injury, but it is very important to remember that you are not the only one with an injury. If a third party is injured while on your job with your Employer is responsible for providing medical treatment, but they cannot be held liable for any malpractice. If you have a long term medical condition, it may be necessary for a Managing Care Provider to be referred to. If you do not have access to a medical doctor or there is no one available to treat your injury, the Workers Compensation board will determine what type of specialist is necessary to be referred to.

When you have your initial Workers Comp examination, it is vitally important that you have an honest answer to the question posed by the physician. Many times injured workers attempt to downplay their injuries, but the exam is not designed to determine whether or not you were injured for purely work related reasons. When you go in for your initial examination you may choose to provide some false information, but later you may have to be asked to provide accurate information. False information can potentially place your claim at risk. An injured worker's compensation attorney may choose to challenge your initial evaluation and may choose to have you undergo additional medical treatments.

The Employer's role in a Workers Compensation case is important. In some cases they have the right to request a second or even a third medical visit. On the first visit the doctor can discuss your details with the claims adjuster and determine whether or not you should file a claim. At this point the employer has the opportunity to try and negotiate with the worker. They may decide to settle the injury for less money or request more time before the claiming party receives their payment. If you do not receive a settlement from your Employer, the next step will be to go in for a hearing with the Claims Adjusting Board.
