Proper Explanation of Timelines Extension for GST Compliance

The Central Board of Indirect Taxes and Customs (CBIC) issued a press release clarifying doubts regarding extensions of timelines for various provisions under the GST Act 2017.

As a result of various amendments to GST (Goods and Services Tax) under the Finance Act 2022, CBIC (Central Board of Indirect Taxes and Customs) notified various amendments on 28 September 2022, effective from 1 October 2022. A number of compliances were changed from the deadline for filing September returns to 30th November 2022 of the following financial year (FY), including the availability of GST ITC, disclosure of credit notes, correction of errors or omissions in form GSTR-1, GSTR-3B, and return of tax collected at source.

Following are clarifications from CBIC relating to the changes made to timelines:

Particulars and Clarification for FY 2021-22

Query. Are compliances pertaining to FY (financial year) 2021-22 affected by the extension?

Solution. For compliances related to FY (financial year) 2021-22, the extended timelines apply.

Query. When do the deadlines end for providing the November return/statement or do they extend until 30 November?

Solution. If compliance is necessary with respect to a financial year (FY), it can be carried out in the return/statement furnished up to 30 November of the following FY or in the annual report, whichever comes first.

As a result of this Notification, the due dates for filing returns/statements for October and September have not been extended.
